İşbu sözleşmenin konusu; Alıcının, Satıcıya ait web sitesinden elektronik ortamda sipariş verdiği ürünün satışı ve teslimi ile tarafların 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği uyarınca hak ve yükümlülüklerinin belirlenmesidir.The subject of this agreement is the sale and delivery of the product the Buyer orders electronically from the Seller's website, and the determination of the parties' rights and obligations under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
3. Sözleşme Konusu Ürün, Ödeme ve Teslimat3. Product Subject to the Agreement, Payment and Delivery
Ürünün adı, adedi, satış fiyatı (KDV dahil), ödeme şekli, teslimat adresi ve kargo bilgileri; sipariş onayı sırasında Alıcıya gösterilen sipariş özetinde ve sipariş sonrası gönderilen onay e-postasında yer alır ve bu sözleşmenin ayrılmaz parçasıdır.The product's name, quantity, sale price (VAT included), payment method, delivery address and shipping details appear in the order summary shown to the Buyer at order confirmation and in the confirmation email sent after the order, and form an integral part of this agreement.
4. Genel Hükümler4. General Provisions
Alıcı; ürünün temel nitelikleri, satış fiyatı, ödeme ve teslimat bilgileri ile cayma hakkına ilişkin ön bilgileri okuyup bilgi sahibi olduğunu ve elektronik ortamda onay verdiğini kabul eder. Satıcı, sözleşme konusu ürünü sağlam, eksiksiz ve mevzuata uygun şekilde teslim etmekle yükümlüdür. Mücbir sebep hâllerinde Satıcı teslimatı durdurabilir veya iptal edebilir; bu durumda Alıcıya bilgi verilir ve tahsil edilen bedel iade edilir.The Buyer acknowledges having read and been informed of the preliminary information on the product's essential characteristics, sale price, payment and delivery details and the right of withdrawal, and having given confirmation electronically. The Seller is obliged to deliver the product intact, complete and in compliance with the legislation. In cases of force majeure the Seller may suspend or cancel delivery; in that case the Buyer is informed and any amount collected is refunded.
5. Cayma Hakkı5. Right of Withdrawal
Alıcı, ürünü teslim aldığı tarihten itibaren 14 (on dört) gün içinde herhangi bir gerekçe göstermeksizin ve cezai şart ödemeksizin sözleşmeden cayma hakkına sahiptir. Cayma hakkının kullanılması hâlinde ürün, faturası ve eksiksiz aksesuarlarıyla birlikte iade edilir. İade ve geri ödeme süreçleri İade Politikasında ayrıntılı olarak açıklanmıştır.The Buyer has the right to withdraw from the agreement within 14 (fourteen) days of receiving the product, without giving any reason and without paying any penalty. If the right of withdrawal is exercised, the product is returned with its invoice and complete accessories. Return and refund processes are explained in detail in the Return Policy.
6. Cayma Hakkının Kullanılamayacağı Hâller6. Cases Where the Right of Withdrawal Cannot Be Exercised
Mevzuat gereği; tesliminden sonra ambalajı/koruyucu bandı açılmış olan, sağlık ve hijyen açısından iadesi uygun olmayan ürünler (takviye edici gıdalar dâhil) ile çabuk bozulabilen veya son kullanma tarihi geçebilecek ürünlerde cayma hakkı kullanılamaz. Ürünün ambalajı açılmamış, kullanılmamış ve yeniden satılabilir durumda olması hâlinde iade kabul edilir.By law, the right of withdrawal cannot be exercised for products whose packaging/protective seal has been opened after delivery and that are unsuitable for return for health and hygiene reasons (including food supplements), and for perishable products or those that may pass their expiry date. Returns are accepted if the product's packaging is unopened, unused and in resalable condition.
7. Teslimat7. Delivery
Ürün, Alıcının siparişte belirttiği adrese, anlaşmalı kargo firması aracılığıyla, yasal süre olan 30 günü aşmamak üzere en kısa sürede teslim edilir. Kargo takip bilgisi, ürün kargoya verildiğinde Alıcıya iletilir.The product is delivered to the address the Buyer specifies in the order, via the contracted shipping company, as soon as possible and within the statutory period of 30 days. Tracking details are sent to the Buyer when the product ships.
8. Ödeme8. Payment
Ödeme, web sitesinde sunulan güvenli ödeme yöntemleri ile yapılır. Kredi/banka kartı bilgileri Satıcı tarafından saklanmaz; ödeme, yetkili ödeme kuruluşunun güvenli altyapısı üzerinden gerçekleştirilir.Payment is made via the secure payment methods offered on the website. Credit/debit card details are not stored by the Seller; payment is processed through the secure infrastructure of the authorised payment institution.
9. Temerrüt9. Default
Alıcının temerrüde düşmesi hâlinde, Alıcı borcun gecikmeli ifasından doğan zararlardan sorumludur. Ödemenin ilgili banka/ödeme kuruluşunca gerçekleştirilememesi hâlinde Satıcının teslimat yükümlülüğü sona erer.If the Buyer defaults, the Buyer is liable for damages arising from the delayed performance of the debt. If the payment cannot be completed by the relevant bank/payment institution, the Seller's delivery obligation ends.
10. Uyuşmazlıkların Çözümü10. Dispute Resolution
İşbu sözleşmeden doğan uyuşmazlıklarda, Ticaret Bakanlığınca ilan edilen parasal sınırlar dâhilinde Alıcının yerleşim yerindeki Tüketici Hakem Heyetleri ile Tüketici Mahkemeleri yetkilidir.In disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence are competent, within the monetary limits announced by the Turkish Ministry of Trade.
11. Yürürlük11. Entry into Force
Alıcının siparişi elektronik ortamda onaylaması ile işbu sözleşme yürürlüğe girer ve taraflarca okunup kabul edilmiş sayılır.This agreement enters into force when the Buyer confirms the order electronically and is deemed to have been read and accepted by the parties.
